These Terms of Service (“Terms”) govern your use of the EasyPassportPhoto website and service at easypassportphoto.com (the “Service”), operated by EasyPassportPhoto Ltd (“we”, “us”, or “our”).
By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. The Service
EasyPassportPhoto is an online passport photo service that allows you to:
- Upload or capture a photo using your device's camera
- Have the photo automatically processed to meet official passport photo requirements for your selected country
- Download the processed photo as a digital file and/or receive a digital photo code (where applicable)
We use artificial intelligence to process photos, including background removal, lighting correction, cropping, and compliance checking. While our technology is designed to produce compliant photos, we cannot guarantee that every photo will be accepted by every passport office or government agency, as acceptance criteria may vary and can be applied subjectively.
3. Pricing and Payment
The price for the Service is displayed before you proceed to checkout. All prices include VAT where applicable.
Payments are processed securely by Stripe, Inc. We do not store your payment card details. By making a purchase, you authorise us to charge the displayed amount via your selected payment method.
You may process photos for review before purchasing. Payment is only required to download the final high-resolution photo and/or receive a digital photo code.
4. Money-Back Guarantee
We offer a 100% money-back guarantee. If your passport photo is rejected by the relevant government authority (e.g. HM Passport Office for UK applications, or the U.S. Department of State for US applications), we will provide a full refund.
To claim a refund under this guarantee:
- Contact us at support@easypassportphoto.com within 30 days of purchase
- Provide evidence of the rejection (e.g. rejection letter or screenshot from the application portal)
- The photo submitted must be the unmodified photo produced by our Service
Refunds are processed via the original payment method within 5-10 business days.
5. Acceptable Use
You agree to use the Service only for its intended purpose of creating passport and identity document photos. You must not:
- Upload photos of anyone other than yourself or someone who has given you permission
- Upload content that is illegal, offensive, or infringes on others' rights
- Attempt to reverse-engineer, copy, or extract our photo processing technology
- Use automated tools, bots, or scrapers to access the Service
- Interfere with the security or proper functioning of the Service
We reserve the right to suspend or terminate access to the Service if we reasonably believe you have violated these Terms.
6. Intellectual Property
Your photos: You retain ownership of the photos you upload. By using the Service, you grant us a limited licence to process your photos solely for the purpose of providing the Service.
Our Service: All other content, design, software, and technology used in the Service is owned by or licensed to EasyPassportPhoto Ltd and is protected by intellectual property laws. You may not copy, modify, or distribute any part of our Service without our written permission.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability in connection with the Service is limited to the amount you paid for the specific transaction giving rise to the claim.
We are not liable for any indirect, incidental, or consequential losses, including but not limited to delays in passport applications, missed travel, or additional costs arising from photo rejection.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data, including your photographs.
9. Changes to the Service and Terms
We may update the Service or these Terms from time to time. If we make material changes to these Terms, we will update the date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
